Exactly, so how could they be grandfathered in. It was the towns legal counsel who made that statement in July, I did not make it up. The permits for the building stated agricultural storage, not medical mj. They could have had medical mj on them because one month later they informed the town officially they were going after a license. The town permitted a pole barn, everyone assumed they permitted a medical mj facility.
The biggest verdict which will be passed on tonight's decision will be by the market. I was hoping they would have had the town go through the zoning amendment application process which I felt all along was their best option since lawful nonconforming would not be a factor. Jim tried to have that land rezoned and failed but having only the processing restrictions removed would be the best bet for them.
There certainly was some bad blood spilled before the meeting got adjourned with mentions of evidence, judges, moving, litigation and so on.
