It's only his sentence that he's appealing. He fully admits to the crimes of which he was accused.
Even if the 9th Circuit reduces his sentence to probation (while he far less guilty accomplice Dadonna got actual prison time, his fault for not having the money for a fancy lawyer), the conviction will still stand.
