Looks to me that the 10K was already amended! Hence the 10K/A! What exactly do you want him to amend?? You are no being very clear. What is in or out of the 10K or Q or whatever? Shareholders have a right to know what is going on here. The company was made public through an IPO, there is an obligation to your shareholders here. Also, there should have been an 8K that demonstrates that you are indeed the CEO now! Where is that filing JOE??
