I would think that SA told Cytodyn the settlement amount was "fair". If they believed waiting or going to court in August would have rendered a "more fair" agreement, they would have recommended it.
The time not spent negotiating or battling in court means the money is in the company's coffers. Money not borrowed is money saved, especially at current rates. A 5%+ return on Cytodyn's money can accrue and be used as needed.
CYDY isn't in the litigation business; it's in R&D. You can't do R&D well without funding. The current interest rate environment has been a headwind to small biotech or any other small enterprise that needs funds. Cytodyn now has their own.
