I am all but certain that when buying Amarex, NSF put a clause in the contract indemnifying NSF against anything that Amarex had done up until that point. That would be standard operating procedure.
Also, we can all think what we want, there is always the truth and the truth that lies behind it. EVERYONE, including companies, is entitled to a defense. It may turn out to be garbage, or there may be some merit to whatever Amarex has to say. Smart people don't jump to conclusions, no matter how things look on their face or how much emotion they have involved in it. I want to know both sides and THEN make my decision, although I again agree that ON ITS FACE, it doesn't look good for Amarex.
Did Ted Bundy kill people? Yes, we knew that going in, with 100% certainty, but he was entitled to have a defense heard on his behalf before he was sentenced. God bless America.
