Or they listed NSF, so when it came to settlement talks, they could threaten to bring them up again and get a bigger payment.
They were not technically off the hook.
(in my non lawyer opinion), they PR’d an expected more than 100M settlement to show they’re serious about getting some dough for the negligence/malicious intent.
Or, maybe you’re right, but whatever the situation is, they felt safe enough to tell us, $100M+ was likely on the table
