I don't understand your sentence about "refusal to pay being conditioned by the liability assigned by the courts" as that doesn't make sense as a sentence. You might be right about something, I am just not sure what you are saying.
As I read the agreement, this is BINDING ARBITRATION, end of story, and most likely what you mean could be that the arbitration award could be enforced by the courts...but nothing more than that. CYDY is 100% NOT "in the ring" with the courts. Absolutely not.
