“Jake, how would you categorize Amarex refusing to turn over the data and refusing to submit to audits that are permitted under the contract?”
If I recall correctly, the reason Amarex refused the audits, was ‘lack of payment for services’. Which, if I’m not mistaken, is why we had to put up the 6.5 million dollar bond, to begin the arbitration, as well as largely the subject of the arbitration. Separate of course from a suit for damages.
My read on un limiting damages is that if “gross negligence” can be established, we can get more from Amarex. I have no idea if we can establish gross negligence, but I for one am not counting on it as an investment strategy.
