In response to post 129938, CYDY can, if allowed by the MSA, file for damages and legal fees as part of an arbitration. Most likely, the arbitration clause in the MSA provided for legal fees in certain instances, and damages as well, most likely liquidated damages, which is a pre-determined amount that the parties agreed to in the event of breach, as it would be very hard to determine actual damages in a case like this. This is VERY common and Amarex's attorney would most likely have asked for liquidated damages. It also makes it MUCH easier for an arbitrator to award such damages in much shorter order than in would to spend weeks or months determining market share, CYDY's potential to get the drug to market, etc.
