Given that this is arbitration, I think the damages will be negotiated into the overall settlement. I don't think there will be a second trial/arbitration for damages. Given the potential size of the damages, possibly in the billions, a third of that may still be in the billions. Add to that their fees likely in the tens to hundreds of millions and you have their motivation.

If they come away with shares as well, that is just the creme on top.

I don't think anything will be left of Amarex when this is done.
