Pestell got the warrants either because Cytodyn attorneys knew they would lose the case or because Cytodyn's financial problems directed a cheaper-to-settle-than-litigate decision. Its just a routine litigation decision. Were Pourhassan still CEO, the decision would not have been routine.
Pestell's attorneys are almost certainly paid on a contingency fee basis. Pestell doesn't have to lay out any cash. Cytodyn does have to pay hard cash to the Cytodyn attorneys.
The "we look forward to re-engaging with Dr. Pestell" comment is possibly part of the Pestell settlement agreement.
If the "we look forward to re-engaging with Dr. Pestell" comment was made freely, unsolicited, and without reservation by Cytodyn then Urbach sees significant value in Pestell.
