After a brief read of this, it sounds like 13d feel that they have not completed their sec filing process to get on the ballot, so there for the case should be dismissed. They can’t figure out how to file, so the response from cytodyn should be dismissed? Seriously? How about 13d explain themselves, I mean who they are, what they plan and how they are going to do anything. Make the most basic effort to try and win anyone over. The “we’re not don yet” excuse is lame. Am I missing something?
