Every Situation is different. Call the SEC. See what they say. I know people have tried the SEC with lots of OTC stocks after they lose money on a bad bet. After an RS etc. BLAH BLAH BLAH. Even threatened SFOR with the whole SEC thing on IHUB. Didn't amount to anything.
