The 3% number is the percentage of those that have been tested and identified as being infected. It appears that a large percentage of people who get infected, show little or no symptoms and therefore don't get tested at this point.
Until testing is wide spread and the real number of those infected is better quantified, the fatality percentage is going to be overstated. But for now they are focused on those obviously infected so the numbers will change when there is a better sampling of the general population.
As of earlier this week, 8 out of the 9 of the early US fatalities in Washington state were all from the same nursing home.
