Come on...CytoDyn will most definitely NOT be commenting on a lawsuit to which they are not a named party, and probably wouldn't even if they were named. That is just common sense.
What would be interesting to see, is if there is any kind of clause in their agreement with Vyera which would allow them to void the deal under certain circumstances while allowing them to keep the money they already received, which, and this is just a thought, COULD open the door to a clean buyout if some BP were so inclined.
As an attorney, I can tell you that many agreements for talent now include morals clauses, allowing companies to void the deals under certain circumstances. CytoDyn's lawyers would be shrewd to have included some kind of "out" for CytoDyn should things become untenable.
