I agree with your overall assessment. Some individuals or companies will break agreements or do other activities knowing that even if they get caught, the reward outweighs the penalties.

They consider it simply good business overall, because in the end, they still make a nice profit, even with some type of penalty.

Is it unethical? Sure. But do they do it? All the time.
