Just to be fair, there has been a little "marking the close" happening to benefit us for the last few weeks....Not sure how a court would interpret trying to hold the $2 level "marking the close" trades versus trying to take us below $2 "marking the close" trades. I guess intent would play a role. A $1.97 5k share trade 1 second before the close looks pretty suspect to me, given the perception of what is at stake (uplisting and all that depends on it) and the timing of it (we are only days from a dividend a 10-K and a possible uplisting announcement).
