I agree.
The way the last disclosure was worded suggested that the merger agreement was already signed. "a 3rd party biopharmaceutical company with which the Company agreed to merge its Elto Pharma subsidiary into."
That "agreement" was with PGI, not the third party.
Now we are in a situation where we are negotiating with a third party who knows it is life or death (as relates to eltoprazine) that we do the merger. All negotiating leverage lost.
If we can't do merger, PGI terminates the license. 3rd party in driver's seat.
