Being sued for unemployment claims happens to companies every day.
Whether you are laid off or terminated you file an unemployment claim.
If you were terminated with cause, most companies will fight the unemployment claim.
Your case is then brought up in front of a board and they decide if the employee has a legitimate claim.
No lawyers involved necessarily. The representative from the company could be the employees direct supervisor. If the company does not send a representative to the hearing to state why they are denying the claim, the claim will probably be decided in favor of the employee.
There is no direct money out of the companies pocket. Companies are required to have Unemployment Insurance to cover these events.
The worst thing that could happen is that their insurance premiums could go up if they have too many claims against them.
