I agree with this. look up the Alice ruling, which stands very much to be challenged.
that's a tough nut but one that can easily be cracked.
when looking at Alice: does the fact that the idea relies on the need for a new mode of communication FOR the mode of communication to operate matter?
if we go back to smoke signals, then absolutely yes. and all other examples follow.
