Based on the IPR ruling it looks like we will ultimately prevail and SPLIT is correct in his assessment in my opinion. The article is straightforward in the beginning and the end that the IPR should take precedence. ( goes around and around in the middle in my opinion) That being said it is extremely confusing and Ropes and Gray will need to sort through the details and discuss how to proceed.
