That's exactly what it is & beyond that, there's no guarantee any capital gains will actually be realized in the end...could easily be a loss. Aside from this new phantom-tax measure & with this new low-bar in financial justice being set, there's no guarantee that they won't eliminate the capital loss carry-over deduction as well.
