Hypothetically,
Since Nanologix (the company) "DOES NOT OWN THE PATENTS" and the N-Assay patents "are owned" by Dr. Faro and BB himself, they don't have to deal with NANOLOGIX at all. Just offer the good Doctor and BB enough money and they can buy the patent themselves. Manufacturing would be done at the NEW companies location and the NNLX shareholders get dry humped.
Just my opinion.
