Reputation is very subjective. Did these Mako articles damage CTIX's reputation in the eyes of Pfizer, Celgene and other BPs? CTIX doesn't sell products and convincing a judge that BPs put much weight in SA articles is tough.
It varies from venue to venue but it appears to be a moot point. I still await a piece of case law which sets a stronger precedent than NNVC vs SA. Similar company, same writer (we think), same formula and same Seeking Alpha just two years ago. I believe that even if the SEC asked for a subpoena the presiding judge would review that case and have to throw it out.
