That's what I said in the post before this one. The SEC has the authority to if they believe securities fraud was committed. They would have to believe they have an answer to the opinion defense in order to subpoena Seeking Alpha. I'm not aware of a case where SA has complied with a subpoena since the NNVC vs SA case. It was a major piece of case law.
As I said, I believe they need to uncover evidence of a conspiracy first. If there is evidence of manipulative trading that is the easiest place to start. Subpoena up the chain until someone knows Mako or Rosen or a BP.
