So you would prefer the Judge render her decision based upon options currently worth $0 rather than options that are worth millions?
A decision today grants CTIX something between $0 and $500K (whatever the options were valued at...something in the $400K range if I recall).
A decision in a year (assume share price =$20) will grant CTIX $18.3M.
Either way CTIX breaks even. In the first case Rosen laughs it off. In the second case...well ouch.
The lack of appeal, in my opinion, signals that Rosen and CTIX have come to an agreement. I think this is the only point where Rosen gets a bloody nose. I wouldn't be surprised if the Judge is delaying if at all possible in order to punish Rosen more heavily. The stock price isn't cooperating though.
