Your entire argument fall apart on these two myths:
Marbury V Madison established the principle of Judicial Review which is used to decide cases brought to the Court; cases based upon challenges to the constitutionality of Bills and to violations of the Constitution. Those decisions have the power of law. So an amendment is NOT required to change laws.
That's been a righty complaint since FDR, at least. It's just another variation on 'facts have a liberal bias'.
