I did a tiny bit of digging on that possibility right after Rosen filed the lawsuit. I was left with the conclusion that such a case would probably be a precedent setting case. I turned up examples of suing your own lawyer for negligence but was unable to find an example that would fit our circumstances. Would love to know if anyone here finds an example of shareholders receiving damages over a failed frivolous lawsuit.
