I think you're missing the point. HJOE is not going to withdraw their counter claims. The best thing KBM can do is file their response, puff and pound their chest a little more, then settle with an NDA and move along. If they take it to trial, they're looking at full exposure. How terrific would that be for your investment. Right? You're invested. Right? Or wrong.
