If you look at the other lawsuits KBM has filed against companies that defaulted by not making their SEC filings, KBM withdrew the lawsuits against those companies that subsequently became current again. There's no reason to think they wouldn't withdraw this lawsuit too if HJOE became current. If that happened, then KBM would simply convert the 43K at about .0007-.0008 per share or about 61 million shares.
