Rosen submitted the case to the jurisdiction of the NY court.Therefore they can't cry "wrong venue".
Sullivan made the venue a point from the beginning and again in their motion to dismiss.That,in effect,is telling the judge,"either you rule in our favor or this case will most certainly be appealed and we will win." (and judges hate having their rulings overturned on appeal).Rosen on the other hand might be stupid enough to appeal the dismissal but they will most certainly lose there also.If they do try to appeal,it would only be to try to buy time before the ax finally falls.
