The judge has not yet ruled on the issue of default, the court clerk merely entered a default order after the necessary time had passed for CRGP to respond. While it is customary for the judge to follow up with the default judgment, its not always immediate. To my knowledge the judge in this case hasn't ruled on anything, are we even sure we know who the judge is? There are several open motions now ripe for ruling.
