The company offers the buyout for the float (OS = Float + restricted). If there are more shares out there, it is because of naked shorting.
After the share buyback, does the company has the real shares and investors (us) have the air shares? Not necessarily. There's no way to know. Each of us may have a combination of real-air shares that's impossible to trace.
Who pays for the air shares? Our friend shortie. And this explains ETrade's desperate position and Ihub bashing (check who the add in all iHub posts belongs to).
Are naked shorts legal? Yes and no. It is allowed for MMs to sell you a position that they don't have "in the name of liquidity", but they are supposed to immediately cover by getting those shares from other MMs. In practice, this is abused and unreported.
