This is a fact. The NASDAQ rules clearly end our debate. They have to file an 8K or issue a press release upon getting a no from NASDAQ. So no news is good news for now.
NASDAQ RULE 5810(b) provides that if a company looking to uplist receives a negative determination from NASDAQ such a company "is required to make a public announcement disclosing receipt of the notification and the Rule(s) upon which the deficiency is based, and describing each specific basis and concern identified by Nasdaq in reaching its determination that the Company does not meet the listing standard."
"The Company may make the public announcement either by filing a Form 8-K, where required by SEC rules, or by issuing a press release."
