The company has made no mention of the increase in AS being a condition for uplisting, and there is no requirement stated in the Nasdaq Listing Guide that has been posted here many times
I believe, based on what our CFO stated on the latest investor conference call, that the AS increase is tied to the IPO/shelf offering, which is supposed to coincide with the uplisting. Based on this, we should still be able to uplist even if the AS increase is voted down, although it would put the company in a precarious financial situation with little few remaining shares to raise capital, and might force a partnership agreement on less than favorable terms than might otherwise be available.
