Ticker and cusip change: No. It's not fraudulent to change the ticker. It's unsavory because it effectively hides the history from new investors but its not fraudulent.
Latest SEC filing: Lying by omission since at no point did the SEC filings ever correct Mr. Bordynuik's false statements about being able to make a product for under $10/bbl and to be able to sell that product for WTI-$3/bbl. Those false claims were clearly communicated to shareholders in the past and the company continues to allow investors to believe those fake numbers.
Five year solid waste permit: No. It's not fraudulent to get a permit.
