Xockets Takes Legal Action Against Amazon Over Patent Violations

Xockets Takes Legal Action Against Amazon Over Patent Violations

Xockets Initiates Legal Proceedings Against Amazon

Seeking Damages and Injunctions to Protect Intellectual Property Rights

Xockets, Inc., a pioneering company inventing advanced Data Processing Units (DPUs) for enhanced performance in cloud computing and artificial intelligence, has launched lawsuits against both Amazon.com, Inc. and Amazon Web Services. This legal action was taken as Xockets contends that Amazon has unlawfully infringed upon its patented technologies without authorization.

The complaints were filed in the U.S. District Court for the Western District and claim Amazon has persistently disregarded Xockets’ patent rights related to its innovative DPU technologies, which are crucial for modern cloud services and the advancement of AI.

Xockets argues that Amazon’s reliance on its DPU innovations has allowed the latter to significantly boost cloud computing efficiency and reduce operational expenses, thereby enhancing competitive positioning in the market. Notably, Amazon's Annapurna Labs is cited as a principal hub for the infringement activities.

According to Xockets, the infringement pervades Amazon's cloud capabilities, affecting vital systems such as compute, storage, and AI servers, including the integrated Nitro-branded DPU systems operating with Elastic Fabric Adapters (EFAs) and Elastic Network Adapters (ENAs).

Robert Cote, a member of Xockets’ board and an early investor, emphasized the gravity of this matter beyond mere patents, stating that the essence of innovation must be respected and protected, especially against exploitation by larger entities.

Xockets also revealed a troubling history with Amazon, stating that in a previous engagement, Amazon undertook detailed studies of Xockets' DPU technologies under the guise of a potential acquisition but later introduced their own versions of these innovations in their cloud infrastructure.

Over 20 million Amazon servers have now reportedly been fitted with Nitro DPUs, each generating substantial financial advantages for Amazon estimated between $15,000 to $30,000 per server derived from the utilization of Xockets’ technology.

When Xockets identified the infringement issues emerging from Amazon's Annapurna Labs, they attempted to resolve the matter amicably in 2024 but were met with resistance from Amazon, prompting the current legal action.

The lawsuits highlight two primary complaints. The first alleges that Amazon has infringed on three patents related to Xockets' DPU computing architecture, which is essential for processing data-heavy workloads effectively. The patents mentioned in this complaint include U.S. Patent Nos. 11,080,209, 10,649,924, and 11,082,350.

The second complaint targets four additional patents concerning the DPU switching architecture, utilized in cloud infrastructure to enhance distributed computing capabilities. Asserted in this matter are U.S. Patent Nos. 10,223,297, 10,212,092, 9,378,161, and 9,436,640.

These lawsuits not only seek monetary damages but strongly call for injunctions to thwart Amazon's ongoing and allegedly unlawful utilization of Xockets’ patented technologies in its cloud operations.

The recent alignment of the U.S. Department of Justice’s Antitrust Division with the U.S. Patent & Trademark Office, advocating for stricter enforcement measures to prevent patent infringements, reflects how critical safeguarding innovations has become for America's technological landscape.

Consequently, Xockets has expressed the urgency of a resolution to this matter, highlighting the severe repercussions of Amazon's actions on its business and patent rights.

Legal representation for Xockets in this significant case comes from Susman Godfrey LLP, a reputable law firm capable of navigating complex patent litigation.
