Vicor Secures ITC Ruling Against Infringing Power Modules

Vicor Secures ITC Ruling Against Infringing Power Modules

Vicor's ITC Determination Impacting Power Modules

Vicor Corporation (NASDAQ: VICR) recently announced a significant ruling from the International Trade Commission (ITC) that impacts the importation of power modules and computing systems that infringe on its patents. This development has heightened awareness within the industry about intellectual property rights and the enforcement of such rights in a global marketplace.

Details of the ITC's Ruling

On February 13, the ITC confirmed the validity of Vicor's patents—specifically, U.S. Patent Nos. 9,516,761 and 9,166,481. The Notice of Final Determination concluded that certain power converter modules and computing systems that incorporate Vicor's technology would be barred from entering the United States.

The Specifics of the Order

The ruling includes a Limited Exclusion Order against all implicated companies, meaning that importation of these infringing products is prohibited. Additionally, targeted Cease and Desist Orders have been issued against major manufacturers including Delta Electronics (Americas) Ltd., Quanta Computer USA Inc., and others. This reinforces Vicor's stance in protecting its innovations and the competitive landscape of the power electronics sector.

Next Steps for Respondents

After the ITC's ruling, there is a mandatory 60-day presidential review period. During this time, respondents can still import infringing products if they post a bond equivalent to 100% of the product's value. Once the review period ends, however, the enforcement against these infringing modules and systems becomes absolute, effectively blocking them from the U.S. market.

Appeal Against the Determination

Interestingly, the ITC’s decision reversed a previous finding about certain Foxconn affiliates. Initially, Foxconn was believed to be operating without a license to use Vicor's patents; however, the ruling identified that FII USA, Inc. and Ingrasys Technology, Inc. hold a license to use the ’761 patent due to boilerplate agreements present in their purchase orders with Vicor. In response, Vicor plans to appeal this decision in the Federal Circuit to assert its rights more firmly.

CEO's Insights on the Ruling

Vicor's Chief Executive Officer, Dr. Patrizio Vinciarelli, expressed the company's commitment to enforcing its intellectual property rights. He noted, "As expected, Respondents are now subject to exclusion and cease and desist orders, exposing their unlicensed customers to significant consequences." This statement highlights how critical the defense of intellectual property is in the tech industry, particularly as it pertains to advancements in AI and computing systems.

Implications for the Industry

Reflecting on the ruling, Vinciarelli pointed out that many Original Equipment Manufacturer (OEM) and non-OEM customers have sought licenses to avoid disruptions in their supply chains. This move demonstrates an industry-wide recognition of the importance of compliance with patented technologies, particularly with the rapid development of computing systems that are increasingly reliant on advanced power management technologies.
