Traditionally, our negotiations have been transparent, with the company providing data on production and classifications without requiring NDAs. This sudden shift indicates a troubling change in their approach to negotiations.

Workers Caught by Surprise

The situation escalated in October when approximately 100 workers arrived at the 51st Street location for their scheduled shifts, only to discover that they were laid off without warning. Pepsi had alerted the authorities about the closure a week prior but failed to inform the employees affected by the decision, leaving them in shock and confusion as they were escorted from the premises by police.

Legal Violations by Pepsi

Pepsi’s actions have not only breached union contracts but also violated the Worker Adjustment and Retraining Notification Act, alongside the National Labor Relations Act. In response, Local 727 has initiated several lawsuits along with unfair labor practice claims, highlighting the company's illegal conduct.

Concerns Over Transparency

Furthermore, Pepsi's responses to the union's requests for information regarding production volume and facility capacity were incomplete and delayed. They claimed they would provide comprehensive data only if Teamsters signed the unwelcome NDAs, which would restrict the union’s ability to discuss concerns with its own members.
