As previously announced in the Exchange and Clearing Information no 42/13, NASDAQ OMX Clearing will as of October 1 st introduce restrictions on the use of bank guarantees as collateral. This is due to requirements in the European Market Infrastructure Regulation (EMIR) that NASDAQ OMX Clearing has to comply with.
The following restrictions will apply from October 1 st , 2013:
- Only participants qualified as a non-financial counterparty may use bank guarantees
- Bank guarantees cannot be used to cover Margin Requirements for Allowances Contracts.
To qualify as a non-financial counterparty a Non-Financial Counterparty Declaration form has to be submitted to NASDAQ OMX Clearing before 1 October 2013.
