HemaXellerate was not once HemXellerate. HemXellerate I is HemXellerate I. They are separate trademarks for different products.
HemaXellerate trademark was already completed when the Oregon State muck-up was discovered. What further legalities are required to protect it at this point is a mystery. BUT IT DOESN'T CHANGE THE TREATMENT. And it doesn't change the fact that it is owned by Regen and will soon have FDA approval with orphan drug status. For all we know, this could be the very reason for the time it has taken for the FDA to clear it--the original application was based on information that has since changed based on Oregon State's screw up. They (the FDA) very well could have required some updated information based on this that had to be provided by Oregon State. This is pharma and not socks we are talking about.
