Selling patents to a firm that doesn't make any technology-related products is being seen as a masterstroke by industry watchers. If Nokia sues any other company for patent violations they can sue it back for infringements on their own patents. But a company like Vringo can't be sued back since it doesn't make any products Vringo also sells video ringtones for phones. The company had to issue 9.6 million of shares to raise the money to buy the patents from Nokia.

Shares in the company were trading up 3.21% $3.57 in the opening session.

Head of the digital publishing program at the University of Missouri, Roger Fidler, said in a written declaration that he had started working on a tablet design in 1981 and "Apple personnel were exposed to my tablet ideas and prototypes."

Fidler said that his earliest prototype of the tablet was lightweight, portable, had a flat screen with the ability to respond to touch.

Samsung's whole defence is to discredit Apple's claims of originality in conceiving the designs of its mobile devices.
