Hi, all.
In my inexpert opinion, I'm guessing that Geo is going to be able to set aside the defaults in the California case. Ordinarily, courts strain to allow a case to be heard on its merits and they generally frown upon defaults that were obtained by the "quiet speed" of the plaintiff in seeking the default. I'm not saying that happened here, but, from the case register, it does look like Geo responded fairly quickly after the default was entered in the California case.
If the default is set aside, then Geo might file some sort of motion or another to "abate" the California case pending the outcome of the Texas case, but, of course, it's impossible to say whether that motion would succeed or not.
I, too, and glad to see Cotton & Western's attorney filing things in the Texas case.
Does anyone have any news as to what's happening "on the ground" down in Mexico?
