Nguyen-Geos attorney- apparently filed these Tx case motions
In CWRN case against Geo in Calif neither Geo nor their attorney have even appeared and the court entered a default judgment against Geo Dec 1 -see post 3688- these things are unusual-as we both know ordinarily discovery is done in prep for trial which was set for June 7 in San Diego- so is Geo going to refuse to supply docs/info ordered (past or future) by the court in Ca? while demanding CWRN produce docs in Tx?
In even bringing the TX case Geo took CWRN by surprise I believe because I think from what CWRN emphasized in complaint etc that Jurisdiction was California as emphasized in all but the alternative provision that Geo apparently slipped in-the alternative NAFTA jurisdiction on a later rendition of JVA- which is however limited as to subject matter to Geo's contributions to the JVA and thus does not have the wide range of causes of action that CWRN complaint agst Geo in Ca has
pleading: an overview
Pleading is the beginning stage of a lawsuit in which parties formally submit their claims and defenses. The plaintiff submits a complaint stating the cause of action -- the issue or issues in controversy. The defendant submits an answer stating his or her defenses and denials. The defendant may also submit a counterclaim stating a cause of action against the plaintiff. Pleadings serve an important function of providing notice to the defendant that a lawsuit has been instituted concerning a specific controversy or controversies. It also provides notice to the plaintiff of the defendant's intentions in regards to the suit.
