Judge won't dismiss part of Martha Stewart lawsuit NEW YORK (AP) — A New York State Supreme Court judge has rejected a motion by Martha Stewart Living Omnimedia lawyers to dismiss Macy's claim that the New York-based merchandising and media company violated its pact when it developed certain products for competitor J.C. Penney even though they don't carry the home designer's name.
