Quote:It seems like a simple waiver could be offered to those with no options left: sign the waiver, and the FDA, the Hospital, and the attending MD will not be held liable for any unfavorable outcome, including death.
From the perspective of using leronlimab it makes sense given its safety profile. Overall, not so much. If a patient (or worse, their legal guardian) got the notion that arsenic would cure them it would not be appropriate to give it to them. If the doctors refused any treatment then they could be sued. Under Right to Try or EIND either the FDA, the company or the doctors can refuse. With safety being paramount the current system is adequate. If I'm remembering correctly in some presentation it was said that 99% of all EINDs submitted for leronlimab have been approved.
