FKA: Thank you for providing this claim submission doc and info from the Kessler Topaz Law Firm. My previous post #158759 identified the plaintiffs' lead lawyer as Bradley Keller of of Byrnes Keller in Seattle. In an earlier post responding to misui's concern about a $16M settlement, I indicated how concerned I was at the financial threat that this Courter class action posed to CYDY because the trial judge had appointed Keller, a very seasoned legal malpractice defense attorney, as lead trial counsel and the brief Keller had filed in opposition to CYDY's Motion to Dismiss the Complaint had referenced a plethora of concerning evidence.
While my limited internet access to the court file led me to conclude that Judge Settles had appointed Keller as lead trial counsel, that would be an unusual procedure, and it makes more sense that the class action law firm that had filed the complaint, Kessler Topaz, probably brought Bradley Kessler in as lead trial counsel and Judge Settles had merely approved Keller's addition to plaintiffs' counsel. Now, with the case in settlement mode, Kessler Topaz, with their experience in closing out class action settlements, is apparently back in the lead.
So I apologize to the board for previously identifying the wrong law firm to contact regarding the settlement claim filing process, as well as the wrong stock purchase closing date ( which date may have been extended by a later court order or simply was misrecorded by me).
To reiterate, however, from my original post responding to misui, the salient detail for me in all of this was that some of Courter's claims appeared to have merit and were much more potentially threatening to CYDY (and us) in the hands of a top notch trial lawyer, and that is what Keller appeared to be. I am very relieved that this settlement has been achieved by CYDY and its counsel.
