Correct he can make a registration draft statement, which only the SEC staff can review, he has to still make a public filing before the registration is effective.
If I remember correctly all registration statements and all non-public draft submissions are available on EDGAR at least 15 days before it hits the fan.
In my opinion he needs to launch "NOW" all this other can come later. Shareholders deserve it now, no more delays.
