California Extends Prohibition of Hemp Products with THC

California recently extended a ban on intoxicating hemp products with THC that was set to expire before the end of March. This comes just months after the ban went into effect following legislators’ failure to approve a measure that would’ve regulated these products.

Gov. Gavin Newsom first introduced the ban in September 2024, with the Office of Administrative Law approving the emergency rules that same month. Under the ban, the sale of consumable hemp products with any amount of THC was forbidden.

THC is one of the main psychoactive compounds found in cannabis, CBD being the other. Unlike CBD though, THC induces a high when ingested, either orally or by smoking.

The ban also imposed a limit of 5 servings for every package of hemp product. This is in addition to limiting the sale of hemp dietary supplements, drinks and foods to only customers aged 21 and above.

The prohibition wasn’t welcomed by many in the hemp industry, who argued that the rules prohibited products used by millions of consumers in the state, including non-intoxicating products.

In October, the U.S. Hemp Roundtable and a number of businesses filed a petition for a temporary restraining order to block the ban’s enforcement. Sadly, the court did not rule in their favor and left the ban in place. The co-plaintiffs in the case included Cheech and Chong’s Global Holdings, Sunflora, Lucy to be Beverage, Boltd Runners, Blaze Life and Juicetiva.

In a statement, the governor explained that their primary focus was preventing minors from accessing unregulated hemp and cannabis products in retail stores.

General Counsel of the U.S. Hemp Roundtable, Jonathan Miller, claimed that the governor imposed a complete ban on these products instead of addressing concerns raised and implementing a law to regulate hemp products that was approved a few years prior. Miller added that the state needed to ensure every product in the marketplace was tested and AB 45 was enforced.

However, the regulated marijuana industry welcomed the move to tighten hemp regulations, with many arguing that every intoxicating cannabinoid, whether from marijuana or hemp, needed to undergo the same lab tests for contaminants like mold, heavy metals and pesticides. Additionally, some noted that hemp products need to be managed under marijuana’s regulatory structure and be subjected to the same packaging and marketing standards.

A notice to extend the ban filed by California’s public health department allows the rules to continue for another ninety days.
