I recently participated in the plaintiff experience. It certainly was not on this scale. However, it took 20 years to settle. The number of ways the defense can procrastinate is incalculable. The ability to move on with one's life and achieve desired goals is powerful motivation to settle.
There is a time/money continuum that a plaintiff needs to self-determine. It's not $100M, but that probably wasn't going to happen anyway. Besides, as the attorneys will always tell you, "You never know how the judge is gong to rule." A total of $26M as opposed to potentially tens of $millions more is bitter-sweet, but the ability to move forward in a much stronger financial position may be worth it.
How much does the FDA's perception of Cytodyn change? Maybe that is priceless.
